Trooper Michael Pahira Jr. lost his life when his patrol cruiser was struck by a large commercial vehicle traveling along Interstate 81. The driver responsible, identified as Michael Bon, is a 33-year-old national of Haiti who arrived in the United States through a mass parole initiative established during the administration of former President Joe Biden. Federal authorities from the Department of Homeland Security confirmed Bon's entry status following the collision.

Bon had been residing in Brockton, Massachusetts, prior to the incident and held a commercial driver's license issued by that state's Registry of Motor Vehicles. At the time of the crash, Trooper Pahira was conducting an unrelated commercial vehicle inspection south of Frackville when Bon's truck drifted from its lane and collided with the trooper's cruiser.

Legislative Response and the Move-Over Law

State Senator Doug Mastriano, a Republican representing Gettysburg, played a pivotal role in developing Pennsylvania's move-over legislation. His district covers a substantial portion of Interstate 81, which serves as a major corridor for heavy truck traffic. Mastriano explained that his legislative efforts were designed specifically to prevent accidents similar to the one that claimed Trooper Pahira's life.

"I heard from Tom Bricker, a tow truck operator at Abe's Towing out of Chambersburg," Mastriano recalled. "He told me all the close calls he's had, all the friends of his that have been killed or injured by people crashing into the tow trucks … especially on 81, since that goes through our area."

The legislation originated in 2019, marking one of Mastriano's earliest initiatives following his election to the state legislature. The catalyst came after tow truck operator Tyler Laudenslager was fatally struck on Interstate 81 west of Lebanon. Democratic Governor Tom Wolf ultimately signed the move-over law into effect, requiring motorists to either change lanes or reduce speed when approaching tow trucks and emergency vehicles.

Additional Safety Measures

In 2022, Mastriano successfully passed another piece of legislation that permitted tow trucks to activate police-issued blue lights while stopped on the roadway. This measure aimed to increase visibility and alert drivers to exercise greater caution. The senator developed this proposal after consulting with Bricker and other commercial vehicle operators who had experienced similar pilot programs in Midwestern states.

"Trooper Michael should be alive today, had the federal government enforce their own laws protecting the border, making sure only people coming in legally can be on the roads," Mastriano stated, emphasizing the connection between immigration policy and roadway safety.

Political Accountability and Licensing Issues

The incident has sparked debate regarding which level of government bears responsibility for ensuring that commercial drivers possess valid credentials and lawful presence. Pennsylvania Governor Josh Shapiro's administration previously criticized the Department of Homeland Security, noting that the SAVE registry system maintained by the agency identifies noncitizen immigration status and informs PennDOT's licensure decisions.

Both Massachusetts and Pennsylvania have encountered cases involving commercial driver's licenses issued to immigrants residing in the country without proper authorization. Mastriano argued that states possess the authority to address these motor vehicle policy concerns independently.

"Josh Shapiro, please fix this. You have a lot of power here in Pennsylvania, and you're the governor, and so exercise that power. Ask your secretary of transportation to update records to make sure anyone receiving CDL licenses is somebody who's here legally and understands the language and can control a vehicle," Mastriano urged.

He further emphasized that shifting blame exclusively to federal authorities represents an inadequate response to what he characterized as a state-level problem requiring accountability.

Official Responses

State officials from both Massachusetts and Pennsylvania defended their respective licensing frameworks when questioned by media outlets. A spokesperson for the Massachusetts Governor's administration indicated that the defendant should face prosecution under the fullest extent of applicable laws.

"Every non-U.S. citizen who applies for a commercial learner's permit or driver's license in Pennsylvania must provide proof of identity and ... lawful presence in the United States, which is verified with the federal SAVE database, administered," the Pennsylvania statement concluded, noting that the database operates under federal oversight.

The collision has thus become a focal point for discussions surrounding border enforcement, commercial licensing procedures, and the implementation of highway safety legislation designed to protect emergency responders and commercial vehicle operators working along heavily trafficked corridors.
